Federal Court Overturns Education Department Policy Requiring Green Cards for Jay Treaty Students to Receive Federal Aid

A federal court has struck down a U.S. Department of Education policy that mandated Canadian-born Mohawk students, recognized under the Jay Treaty, provide immigration documents like a Green Card to qualify for federal student aid. The U.S. District Court for the Northern District of New York ordered the Department of Education to vacate the policy, which was adopted in January 2025, on September 1, 2026.
