U.S. Department of Justice Sues States Over In-State Tuition for Undocumented Students; Florida Bans Them from Public Higher Education

The U.S. Department of Justice has filed lawsuits against the District of Columbia and three states—Arkansas, Hawai'i, and Utah—challenging their laws that allow certain undocumented students to pay in-state tuition rates and receive state financial aid. This action means the agency has now sued every state offering such benefits. Concurrently, Florida's public university system will ban undocumented students from attending its selective institutions starting in the 2027-28 academic year, a decision that, combined with a similar vote for state colleges, effectively locks undocumented students out of the state's public higher education system.
