Department of the Treasury amends Title VI regulations to eliminate disparate-impact liability

Effective August 3, 2026, the Department of the Treasury has amended its regulations implementing Title VI of the Civil Rights Act of 1964. The final rule rescinds portions of the regulations that prohibited conduct having a disparate impact, aligning them more closely with the statutory text which prohibits intentionally discriminatory conduct. This change aims to conform with Title VI's original public meaning, reduce compliance costs, and implement an executive order on restoring equality of opportunity.
