BIS to Restrict Exports of Critical Minerals for National Security

The Bureau of Industry and Security (BIS) announced new export restrictions on critical minerals and materials, including tungsten waste and scrap, and "black mass" from lithium-ion batteries, effective August 27, 2026. This measure aims to address an "inadequate supply" posing a risk to U.S. national defense and security. The restrictions, outlined in a temporary final rule, will last one year unless revoked, and public comments are being accepted until November 4. This follows President Trump granting the Commerce Department authority under the Defense Production Act for such restrictions.
