FTC Ends Pursuit of Disparate Impact Claims in Discrimination Cases

The Federal Trade Commission (FTC) has issued a policy statement, clarifying it will no longer pursue claims based on disparate impact or "unfair discrimination" theories. Chairman Andrew N. Ferguson stated these claims are difficult to reconcile with a "colorblind Constitution" and can lead to liability without discriminatory intent.
