Supreme Court Declines Review of Guantanamo Plea Deal Dispute, Leaving Death Penalty in Play for 9/11 Accused
The U.S. Supreme Court declined to review a dispute over plea agreements for three men accused in the Sept. 11, 2001, attacks, including Khalid Sheikh Mohammed. This decision leaves in place a federal appellate ruling that allows the government to withdraw agreements that would have spared the accused the death penalty. The plea deals, negotiated in July 2024, were later withdrawn by then-Secretary of Defense Lloyd Austin, a move upheld by the D.C. Circuit Court of Appeals in July 2025.
